Майка ми работи в Дом за деца лишени от родителски грижи и със заповед по чл.328 ал.1 т.2 от Кодекса на труда е прекратено трудовото и правоотношение. И двете са издадени от Кмет на община, но нейни колеги я убеждават, че вече той не и е работодател според чл.18а от Закона за соц.подпомагане, а самият директор на дома. "Чл. 18а. (Нов - ДВ, бр. 15 от 2010 г.) (1) Кметът на общината управлява социалните услуги на територията на съответната община, които са делегирани от държавата дейности и местни дейности, и е работодател на ръководителите на тези услуги с изключение на случаите на възлагане на управлението по ал. 3.
(2) Работодател на персонала в социална услуга, която е делегирана от държавата дейност и местна дейност, е нейният ръководител."
Казано честно - нищо не разбрах..., ако е така както казват колегите и - то защо в кодекса на труда нищо не пише, още повече, че трудовите им договори не са променяни..

в случая мисля, че не трябва да се бъркат понятията - управител, с работодател, те не винаги са тъждествени.
Отговор следва да се търси:
1. От трудовите договори и длъжностната характеристика на работничката /майка ви в случая/
2. От начина на възлагане на управлението, следва внимателно да се разтълкува Чл. 18а. (1) Кметът на общината управлява социалните услуги на територията на съответната община, които са делегирани от държавата дейности и местни дейности, и е работодател на ръководителите на тези услуги с изключение на случаите на възлагане на управлението по ал. 3.
(3) Кметът на общината може да възложи управлението на социалните услуги, които са делегирани от държавата дейности и местни дейности, на лицата по чл. 18, ал. 2 и 3 чрез конкурс или по договаряне при единствен кандидат.
Би могло горепосочения член да се тълкува в смисъл, че кмета може да е работодател на ръководителя, но не и на персонала, чийто такъв е ръководителя на учреждението.
