От 5-ти до 10-ти януари директора на операта всеки ден получавал доклади за отсъствието на Иванов и, че по този начин възпрепятства репетиционния процес на хора. На 20.03. 2010г. Иванов се явил с искане за прекъсване на отпуска и поискал да бъде включен в репетицията. Вместо това бил извикан при директора на операта и в присъствието на юриста му били поискани обяснения за неявяване на работа в периода 5-10 януари и той обяснил, че бил в неплатен отпуск. Още същия ден му била връчена заповед за дисциплинарно уволнение на основание чл. 190, т.3 КТ.
На 22.03 Иванов отишъл да си вземе личните вещи и тъй като междувременно юристът на операта бил разбрал, че е допуснал грешка в правното основание връчил нова заповед за дисциплинарно уволнение, този път на основание чл. 190, ал.1, т.2 KT.
